LOL this one is actually fun. Do not know NY law that well, but here in FL that is self defense. It was also excessive force.Would come down to the ADA, but from what I have seen they would probably not prosecute this, unless it was to go public like this did. The better question is, was the bill legit?

My take:
Hitting woman with pipe who hit you = clean hit (poor taste and judgment but clean)

He was 100% self defence , he stopped hitting them after they fell to the ground , and then the only time hit that wilderbest again was when she tried to get up , hit her twice and then didn't hit that thing again.

Years ago I was in an incident where a airmen pushed me and I crushed his throat. He pushed me once and I told him not to and started to walk away. He got in-front of me and did it again. I chopped him in the throat and he spent 2 weeks in the hospital. When he got out he tried to sue me. His lawyer was gungho until he heard I walked away and was perused. Keep in mind this was civil which is WAY more lax than criminal. The only charge that was ever pending from this in criminal court was mine against him for assaulting me. The level in which is is escalated does not matter in most states so much as justification and preclusion. The guy in this video "in most states" would be fine for flying her head with a pipe. He was assaulted and responded. But you can clearly see that he stopped and then re-inniciated. Defense will argue heat of the moment, and should win but who knows. Again depends on the venue.

None of you have mentioned the fact that it's a black man with a felony record who was defending himself AND as Chuck said the video does show excessive force when he went back a second time. The fact that it was publicized in this manner means at best he gets a plea bargain but he's getting charged with something. There are unfortunately in today's world, three strikes already against him.

If he was your average every day joe (black, white whatever color) it wouldn't matter and he'd probably not get charged. But as a felon, and one with a record of dangerous behavior who has done time, he's not going to slide. At best they reduce it down to simple battery and he gets fired by McDonald's. At worst he has violated parole and he gets tossed back in prison. He just got out last year.
