Internet Posting Removal Act

"Provides that a web site administrator shall, upon request (by the Illinois government)*, remove
any posted comments posted by an anonymous poster unless the anonymous
poster agrees to attach his or her name to the post and confirms that
his or her IP address, legal name, and home address are accurate.
Effective 90 days after becoming law."

*() - Added

“Anonymous Poster” means “any individual who posts a message on a web
site including social networks, blogs, forums, message boards, or any
other discussion site where people can hold conversations in the form of
posted messages.”

Governments looking to remove internet anonymity coming up again.

I think this is a gross overstepping and violation of the 4th Amendment.

"...secure in their persons, houses, papers, and effects..." surely applies to information posted online.

The intent is to have warrantless information of a person Prima Facie of an actual crime.

This is akin to having to wear a big sign in public stating your personal info.

It also opens the door for countless abuses by administrators (don't shoot me Chuck) and governments.

It will never make it out of committee. The irony is he also sponsored the following legislation:

Recently, Silverstein has worked to change the laws regarding identity theft to make it harder for personal information to be shared. Prior to this bill, names and passwords on the computer; cell phone records; e-mails; instant messages; and records of websites visited by an individual were not considered “personal identifying information.” This bill would include that information as private and would prohibit the use of such personal information by brokers.

He also sponsored this:

Senate Bill 1790

Amends the Freedom of Information Act. Provides that names and information of people who have applied for or received Certificates of Firearm Registration are exempt from public inspections and copying.

My guess is he steals all his best ideas from the NY Legislature...

On behalf of the entire internets, elll ohh elll.

Pretty sure this isn't the first bill like this. It won't be the last. Doubt it will pass, and even if it does, good luck enforcing it. The only people who will care are people hosting in Illinois. In other words, all data centers there will suffer, good elsewhere, and avoid. Or increase their retainer.

I'm no lawyer, but I'm pretty sure the content hosted in the other 49 states is not subject to this law. And internationally? GTFO.

Anyone have handy some references to the porn case? I think it was Kentucky who was trying to send cease and desist orders to porn sites for indecency who were in other states? It's basically the same thing.

Just one of hundreds of crazy ideas being kicked around today by our elected officials.

They pull shit like this because 95% of the people out there have zero idea or care about what's going on within their state and federal gov't. Giving a shit about a hillbilly named honey boo boo or what some whore named Kim is up to is way more important then being informed.
