I have had this situation forwarded to me.

I understand you purchased your tuning during a group buy some months back. I understand that you sent the ECU (in working order) to us via USPS, insured and we returned it to you in the same condition also USPS insured. This is our standard shipping process.

Now, you say that the ECU no longer works in your car. We have shipped, literally thousands of ECU’s and have had great success, unfortunately there is the rare occasion that an ECU does get damaged during shipping or handling on customer side. That is the reason we have all customers insure their ECU’s.

We are very clear in our group buys – you get a discount, you pay shipping back and forth, insured, we guarantee our work, will tune the ECU to your satisfaction and there are no refunds.

Your choices here are….go back to the Post Office and make a claim on your damaged ECU, hopefully you have not waited too long to make a timely claim, return the new ECU to us and we will tune it for free or send us your replacement ECU and we will tune it for free.

I realize your time is precious as is mine, and neither of us have the time to drag this out further – but I will take issue with you having the time to verbalize your bigotry during your vent of un-provoked anger. This is unnecessary and a definite waste of your precious time.

Let me know how you wish to proceed, if I do not hear from you within the next 5 business days, I will consider this matter closed.

"Jennifer,

I appreciate the e-mail but you are missing the point. The Post Office here is not willing to pay the claim due to how your employees shipped the ECU- they state it was not appropriate packaging and will not pay the claim. As I explained to Oliver, the three Post Offices I checked with here said that if your company feels it should be covered that your company would need to file with the shipping Post Office that you use. Also, you did not return the ECU to me in the condition I shipped it in. It worked when it left here- that is the original ECU for my car and it has been my daily driver for 2 years with NO ECU issues. It was fully insured both times it came to you, if there was an issue your employees should have contacted me and handled the issue at that point. Also, when I informed Oliver of this he said if the Post Office would not cover the insurance he could do it at your local Post Office and source an ECU. That is what you need to do since my local offices are unwilling to cover the issue due to how your company packaged the item. I am not sure when the last time you did a postal claim was but they don't just pay out because you say it was damaged. Also, you might want to review your company's shipping procedure, not only was the ECU poorly packaged it was only insured for about 1/3 of the contents value.

Let me assure you, there was no mishandling on my side. I am an ASE Master technician and a Volvo Certified mechanic as well, I know the ins and outs of handling an ECU. I've worked on literally 1,000s of Volvos and never had this issue. The manner in which your company shipped the ECU is 100% unacceptable. A thin envelope with no packing material is no way to ship an ECU, which is exactly why the post offices here where I live refused any insurance claim when I approached them about this matter. The reason the ECU is not working is because of how it was shipped.

I guess your company failed to read the group buy as posted on Volvospeed because there is no mention of no refunds. Being the sponsoring company it would also be your responsibility to check the group buy for accuracy. There was plenty of notes about what kind of payment to include, but nothing was mentioned about refunds. I would also like to reiterate that taking payment and not sending goods at all is theft, which at this point is how I view this transaction.

Your employee was the one that started with the comments and hung up on me. You need to teach your employees a bit of customer service- how to not irritate customers and how to handle difficult customer situations. It takes two to argue and your employee did more than his fair share of raising his voice. You should also caution your employee making claims of keeping a customers funds and sending the product they paid for- once again suggesting theft. Also, it is not wise to put a time period on a customer issue, this issue was caused by your staff- NOT me. Also, 5 days is a joke after the 3 months I have been out my $255 and working ECU. I waited over one month to recieve the nonworking ECU and this has went two months without being resolved, a 5 day time period is rediculous. I will not tolerate being bullied by you over this issue, it is not your place to give me a time period- this is a childish tactic that I will not tolerate. I have been more than patient with your company- I sent my payment on time, I sent it the required method- which you quickly cashed and were slow to ship the product. A little taste and customer service on your end would go a long way to resolving this issue. You have not delivered a product at this point of the transaction which I consider theft. This matter is clearly your companys fault and needs to be handled as such. I spend in excess of $20,000 in parts each year for my personal vehicles or my customers and have never had an issue handled so poorly.

Here are YOUR options:

A. Refund my $255 PLUS $75 that I paid for the spare ECU that I am now using in my car.

B: Claim the insurance yourself, find another 1994 850 Turbo ECU, chip said ECU, and ship to me fully insured for $330 the package is clearly worth.

As I stated the Post Offices (3) that are local to me are not willing to cover the insurance claim on the package that your company shipped to me because it was packaged improperly. If you disagree with this you need to take the issue up with your local post office. Additionally, since the Post Office here will not honor the insurance due to how the ECU was pakcaged I cannot supply you with an ECU. I am not willing to send you the ECU in the car because it is my daily driver, especially given the turn around time I've seen with your company. Also, at this point I have very little faith in your company that even if I sent another ECU that it would even be returned to me.

Please consider the options and let me know what you would like to do. I am happy to work with you in any way that I can but as I stated the Post Offices here are not willing to cover the insurance claim due to how the ECU was packaged.

And your point is? You think these posts don't affect sales? Take a basic marketing class....

Also, I had another situation as this happen and the post master took care of it very quickly. No issues there. I never mentioned a lawsuit. You can easily get the local police involved without filing a lawsuit. You are missing the entire point of this, it has nothing to do with the money but a vendor ripping me off. I work hard for every dime I make and I'll be damned if I am going to let someone just walk off with my money without a fight. I didn't get what I have by letting people walk all over me.

They definitely affect sales, as soon as i saw the john ross thing, i had a look and OMFG, i was rethinking gettign a rica tune for sure. And thanks for your post, even though i have not purchased from Oliver, i will not ever buy from him or VMS, as by posting your problems, other people have come out also to tell their stories also, i really don't think it's a 1 in 10 problem, i think he's probably had nervous breakdown cos of so much work, it happens to the best of us, but, in no way should he take it out on you over the phone and be abusive and just man up and fix it, is there a small claims court there, we use comsumer affairs here for that and it only costs like $20.

So I don't want to read through all of these posts, but rule #17 of messing with Volvos is don't mess with speedtuning. Their failure rate is astounding. A few years ago, he shipped my 850 ECU that had my name and address written on it, in sharpie, to someone in Illinois, with an S80. I ended up with an S80 ECU. He refused to do anything.... surprising, I know. I had to get in touch with the guy who had my ECU and each of us paid for express shipping for each other's ECU's. ~$15 is not much compared to being out $300 for an ECU though...

Just FYI, I can assure you that Oliver won't do anything until lawyers/the law get involved.

I'm not going to quote the whole email she sent you vs. your response, to save space and prevent that annoying "quote a shitload" bit, but your response is paramount.

To paraphrase my story I sent my ECU in a case. A waterproof case with foam, no bigger than two briefcases side by side.

Oliver sent my ECU back in a bag with no foam, no watertight protection or anything. He refuses to send the case back at his expense. The local authorites have been contacted.

Oliver is very lucky that my ECU was not damaged like Nick's. Oliver is very un-professional and has poor customer relation skills. Speed tuning should be ashamed to have him representing their product. Cheap tune or not, Oliver risked damaging my ECU and has damaged others by his poor packing.

I am in the process of drawing up a legal forms to send to Oliver. I will sue him and force him to defend himself in my state. If only to make my point, I am willing to pay up front all the money it takes. Because in the end, Oliver and speedtuning will have to repay every dime. I am fully SURE of that. I have a new hobby to add to my list of interests, it's called justice. The first person on my radar is Oliver.

I want my case back.

After a couple years 3 ECU programs, and much much information acquired I have learned to trust only the following for custom programing in the US:

RICA Only with George @ ViVA

Stand Alone

just think if 5% of the people that have read this thread did that for 1 week. how pissed will he get?

How about this idea......Set up a auction on ebay selling something really cheap and put his phone number down. or even set up some craigslist ads and put his number down. there are just soooooooooo many ways just to fuck with someone and get him all pissed off.
