poking cooter punch :lol: my buddies all ride with guns in their packs or storage compartments. no bringing a knife to a gun fight for them. too many stupid ppl driving cars not giving them respect with space and too many bikers acting a fool and doing stuff to piss off the 3000 lbs cars. it all just comes down to what charges the judge decides to give either party at the end of the day.

If he pulled a gun on me he pulled a gun on me. I pulled a knife. He has every right to take out his firearm his he owned/chose to. I would have looked like an ass with a little pocket knife at that point but thats the way it would have gone down.

I think if you were in the situation where your friend was picked up off his bike by the throat you would have done something as well. If you wouldnt, I really wouldnt consider you a friend.

I got this one. Let me see. What would I have done.... let see. Oh I know. How about not doing a burn out and spewing gravel on some one just because you feel their too close. This falls under my one rule for the road. "Don't drive like a douche"

I think everyone missed this post here, you're right! It is sooo easy to become judgemental and say that you over reacted, when honestly that guy had noo monkeyin rights to grab your buddy by his throat ;). Just ride with a gun its better :).

No need to defend myself then. I didnt do the burnout. I just stood up for a friend that was being man handled.

Yeah pretty sure thats felony assault in FL. Look up the 790 laws. And get friends who aren't total retards. It will save you a lot of headaches.

(13) "Weapon" means any dirk, metallic knuckles, slungshot, billie, tear gas gun, chemical weapon or device, or other deadly weapon except a firearm or a common pocketknife.

That is the official definition of a weapon. The knife I have is considered a common pocket knife by law.

784.011 Assault.--

(1) An "assault" is an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.

(2) Whoever commits an assault shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

784.03 Battery; felony battery.--

(1)(a) The offense of battery occurs when a person:

1. Actually and intentionally touches or strikes another person against the will of the other; or

2. Intentionally causes bodily harm to another person.

(B) Except as provided in subsection (2), a person who commits battery commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

(2) A person who has two prior convictions for battery who commits a third or subsequent battery commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. For purposes of this subsection, "conviction" means a determination of guilt that is the result of a plea or a trial, regardless of whether adjudication is withheld.

776.031 Use of force in defense of others.--A person is justified in the use of force, except deadly force, against another when and to the extent that the person reasonably believes that such conduct is necessary to prevent or terminate such other's trespass on, or other tortious or criminal interference with, either real property other than a dwelling or personal property, lawfully in his or her possession or in the possession of another who is a member of his or her immediate family or household or of a person whose property he or she has a legal duty to protect. However, the person is justified in the use of deadly force only if he or she reasonably believes that such force is necessary to prevent the imminent commission of a forcible felony.

In Fl you have to be very careful about defending others. But the big issue is any decent lawyer will argue defense of property and escalation of force against your friend. As soon as he did the burn out he caused the concern for damage to property. From there its a slippery slope. But in most counties in FL the guy would have been within his right if he shot you. So have fun with that as you go through surgeries because your friend has a little penis and apparently cannot finish what he starts.
