Here's the thing, if the item is properly packaged according to the specifications the courier sets, the seller is not responsible the minute it leaves his hands.

Serge, how can you say that? If I ship you something via USPS and they break it during transit, even if the item is well packaged you are not just going to say you are SOL. If I did not buy shipping insurance that is MY fault as the seller. It is a sellers responsibility to make sure his customer is satisfied. I dont just ship you something and if it breaks have you handle everything. I can say with 100% confidence that 99% of the people on here would make a thread JUST like SWM did if this happened to them.

the seller should work with the buyer but he is not... sooo that is the point of this thread.

I'm not trying to argue right and wrong, just what you can argue against the shipping courier. Unless insurance is purchased, it's really difficult to argue a properly packaged box. If the box is poorly packaged, then you can go against the seller. Typically it is the choice of the customer to purchase insurance. On my eBay auctions I have made insurance mandatory for most of my items, simply because if someone doesn't purchase it, they get screwed and come after me (even though I package in extremely large boxes, with lots of peanuts and bubble wrap). I avoid that by packaging my items properly and making sure insurance is purchased. Thus the only person responsible is the shipping courier. As far as customer satisfaction, I deal with the courier to assure they get their money back.

And thats what should be done in this situation. And if the seller can not deal with the courier because he was stupid enough not to buy insurance, then it is his responsibility to replace the item or refund the money. :)

I totally agree with your statement. It seems to me that the seller packaged this lens better than volvo packages it. The seller should def. help out the buyer in getting his money from the courier but not be held responsible for the package getting damaged or for not offering insurance. I may be wrong, but i think the buyer should have told the seller if he wanted insurance or not when purchasing the lens ( IMO ). If ive stated something that was already said, i apoligize, i didnt really read all the posts through :P

Its the sellers responislblity to make sure the product shows up in the condition it was suposed to .

If I bougth something from a store and they ship it to me and it arrives broken back it goes and full refund I get.

Its that simple ;)

If anything the seller can help the buyer resolve the issue with the shipping company, but the seller upheld his end of the deal. Why should the seller pay for USPS screwing up? Why should the buyer pay for USPS screwing up? The seller obviously held up his end of the deal. And making the seller return the money when the item they sold is worthless now doesn't make much sense either. It's the shipping company's fault. It is in the buyer's best interest to pursue the shipping company.

While I also agree with that statement. Only few companies offer that service, and pretty much none are obligated to. That's why Amazon has such good business, they have a no questions asked policy pretty much. If the courier loses the package, they send you a second one right away with same day delivery typically.

Yea if it's a store...as a business it is their duty.

This is person to person, not business to customer.

Again, I am probably just repeating myself but I dont care. If this happened to you, you wouldnt be saying this. If you buy something, you are paying for the item as it was advertised to you. If you receive it and it is in pieces, you wouldnt have paid for it if you knew it was going to arrive like that. This is a great example of "the customer is always right."

Well, I guess this is good because now I know of several people I will NOT buy anything from on VS :lol:

If the seller ships it out in perfect condition, why the hell would they be expected to pay for the shipping company's problem? The damage occurred in transit. The seller is not hand delivering the item.

It's a risk you take buying stuff online.

Thats so stupid. So every time I spend money on something online I should always know there is a chance that I will get screwed over because a shipping company MIGHT break what I ordered? That makes no sense. Man up and replace what you promised the buyer. We can argue day and night about this, but what I really think it comes down to is just basic values and being a good person.
