Thats so stupid. So every time I spend money on something online I should always know there is a chance that I will get screwed over because a shipping company MIGHT break what I ordered? That makes no sense. Man up and replace what you promised the buyer. We can argue day and night about this, but what I really think it comes down to is just basic values and being a good person.

I think you're already there.

Of course things MIGHT break, but typically you will not/should not get screwed over. Its usually only on forums, ebay, and craigslist that people get screwed over. If you are buying from amazon, best buy, sears, etc online you will not get screwed over. They will replace the broken item AS THEY SHOULD.

thats the reason I pay with paypal for everythign so if it does come fuged up I dispute it and get my money back .

He quoted me a price, i paypald the $$, and i got a link to the USPS tracking link. No asking on method or insurance. If people aren't responsible for that they are shipping, it is just poor service. How would anyone know if you are just shipping out DOA items, there is no accountability.

Stop right there. You should not have assumed that he was using a decent shipping service. You should have asked before throwing your money at him. You are partly to blame here.

The seller has spoken (see below) im SOL, until paypal works it out...one way or the other.look, Im not looking for anything to gain here, i wouldn't even be looking for a refund if i DECLINED insurance, but, i wasn't offered it, and i had no idea how he was shipping it to protest his method. if the insurance cost is a nominal fee to add, and the SHIPPER doesn't, then its really just stupidity, if its a big ticket item and the ins is pricey then yes, the BUYER would pay up for ins. The point has been made, if anyone gets something in the mail broken, they would be pissed. the fact is i have ZERO angle with the PO, there is no coverage, no insurance, no nothing, i have ZERO recourse, they have shown me the door already. my only recourse is the shipper, and he wont man up, so paypal dispute it is.

Yes but even on ebay insurance is always an additional cost because some dont want to spend the extra money and some do so it is optional, you never specified if the shipped price included insurance nor did you state that you wanted it. It is always the buyers responsibility, shipping cost and insurance are always seperate from each other, its an option. I am not responsible for what the shipping service does in transit because once It leaves my hands its the shipper, not the sellers responsibility. Thanks

IMO the shipper should refund the money and take it up with the shipping company himself to get his money back. The issue here is you bought it from a regular guy so he doenst need customer service because he doesnt run a buisness, if it was me i would have refunded the money and asked you to ship the product back then i would raise hell with the shipper. Its a sellers job to package things accordingly if its glass ask for a fragile lable to be placed on there, then atleast you showed some effort anyone can wrap something in bubble wrap and shove it in a box, for instance i have a tailight for adam siting in my basement first thing i did was bubble wrap it and place it in a box with alot of news paper enough that the item wouldnt have a chance of breaking

PayPal will likely be a deadend also, as PayPal will not refund against a seller due to damage during shipping. It's for the same principal reasons (not moral or ethical) already stated, you should have confirmed the shipper and that insurance was being purchased on the item.

I'm sorry, but all this back and forth stuff about the seller should have done this and that is all crap. In the end, it's no different than any financial transaction....it's your money, no one will look out for it better than you. If for some reason the seller does not offer/indicate insurance or the shipper, then you should be verifying it yourself...it's basic common sense.

Now with all this "Dave" ranting and arguing Adam is doing....the original post was asking who is right as principal, not what is ethically right or wrong. At no point were both sides of the story given or what conversations SVM had with the seller. I gave my perspective at what the seller is responsible for within the selling process. In principal (or even legally), he is not obligated or responsible to do anything once the item leaves his hands, provided it was reasonably packaged. There is no question to that. A person-to-person transaction can in no way be compared to the business practices of Amazon.

Would I handle this the same way as the seller? No, provided the buyer makes contact with me to work something out. I always pack items well and ship items FedEx and will insure extra if the items value requires it, so I have never worry about this type of situation. But I can say that if a seller went and posted something like this thread about me before trying to resolve it in a civil manner, I would be less likely to help "ethically" and just stick to what I was responisible for in principal.
