This is stupid with how that state law is being used. That is a tragedy and I seen a show on TV (Web of Lies, one of my wife favorite show) where they had another similar story happen to another girl in Northeast state. It is a crazy world out there. She's still being charged for it, just under the state's existing anti-abortion law ironically. Attempted murder in the first should definitely be eligible for the death penalty, although I'm guessing she's going to try an insanity defense and get committed. Read the end of the article, they reference anti-abortion measures that would have made this murder that didn't pass because they were koo koo. Still, I'm not sure that's as straight of an answer. It sounds like a poorly written proposed law that if adjusted (maybe with some malicious intent qualifiers) would be fine. The answer to Alain's question is "the law proposed to make it murder sucked".
